How is the HST late-filing penalty calculated in Canada?

2026-10-05 · 5 min read · Tax Everyday, Vaughan

The penalty for filing a GST/HST return late is 1% of the amount owing, plus 0.25% of that amount for each complete month the return is late, to a maximum of 12 months. A return that is four complete months late is penalized at 2% of the net tax owing: the 1%, plus four times 0.25%. A return that is years late still caps this penalty at 12 months, which is 4% of the amount owing. Interest is not capped that way. Interest compounds at the prescribed rate until the balance is paid, and the rate changes quarterly.

If the return has no amount owing, this penalty is generally nil. You still have to file. People hear “only 4%” and relax, then meet the interest and, where a director is involved, the personal assessment for trust funds. The penalty is the small, predictable part. It is not the whole bill.

A worked shape, not a quote of your account

These are illustrations of the formula. They are not your balance.

  • $10,000 owing, one complete month late: 1.25%, or $125, plus interest.
  • $10,000 owing, 12 or more complete months late: 4%, or $400, plus interest for the whole period.
  • Nothing owing: the late-filing penalty is generally nil. File the nil return anyway.
  • This is not the income-tax penalty. Personal and corporate late-filing penalties use 5% plus 1% a month. Do not mix the formulas.
  • Taxpayer relief can be requested for penalty and interest. It is not automatic, and it looks at the years you have since kept current.

File the return before you debate the penalty

The monthly 0.25% stops growing only when the return is filed, and only up to the cap. Interest stops when the tax is paid. Tax Everyday prepares the late HST returns and shows the penalty formula next to the net tax before you file. Bring the period and the worksheets. If this is part of a ready corporate year, it sits in the $2,000 plus HST package. If it is a stack of late periods, we quote the stack.

Short answers

Is the maximum penalty 4% no matter how late I am?+

The late-filing penalty maxes out after 12 complete months, at 4% of the amount owing. Interest continues after that. Director liability for unremitted net tax is a separate exposure and is not capped by this 4%.

Does the penalty apply to a refund return that I filed late?+

The penalty is calculated on the amount owing. A refund return generally does not draw it. You can still lose the practical use of old input tax credits if you wait past the claim window.
