How does the CRA late-filing penalty work on a personal return?

The penalty and the interest are different charges. On a personal T1, the late-filing penalty applies when you owe tax and the return is late. It is 5% of the unpaid tax, plus 1% of that balance for each full month the return is late, for a maximum of 12 months. A return that is three full months late is penalized at 8% of the balance owing. A return that is two years late is still capped at 12 months for this penalty, which is 17% of the balance. Interest is then charged on top, compounded daily, at the prescribed rate for that quarter.
If the return is late and you are due a refund, this penalty is not the issue. The three-year refund limit is. People mix those up and either panic over a refund year or relax over an owing year. Only the owing year carries this penalty.
When the penalty doubles in rate
The repeated-failure penalty is harsher, and it is not triggered by being late twice in your head. It applies when two things are both true: CRA already charged a late-filing penalty in any of the three preceding years, and CRA issued a formal demand to file this return. The penalty is then 10% of the unpaid tax plus 2% for each full month, up to 20 months.
A demand is a specific letter. A generic “you have not filed” message is a reason to get the return done. It is not, by itself, the repeated-failure rate. Read the letter before you assume the 10% version.
- Balance must be owing. A refund return does not draw this penalty.
- Months are full months. A return 20 days late is the 5% only, from the penalty formula, if no full month has passed.
- The 12-month cap does not cap the interest. Interest continues until the tax is paid.
- Taxpayer relief is a written request, not a phone mood. It can cover up to 10 calendar years of penalties and interest. CRA can say no.
Use the penalty to decide which year to file
Price each owing year with the formula before you negotiate. A $4,000 balance that is eight months late is a $520 penalty before interest: 5% plus 8%. That arithmetic is what a payment arrangement should be built on, not a round-number scare.
Tax Everyday will put that math next to the return before it is filed. Straightforward personal years start at $90 plus HST. Bring the Notice of Assessment if CRA already estimated the year. The real return replaces the estimate. It does not reverse interest that ran while the estimate sat unpaid.
Short answers
Is the penalty charged on the refund I missed?+
No. The late-filing penalty is a percentage of tax owing on a late return. A missed refund is governed by the three-year limit, not by the 5% penalty.
Does paying the tax before filing erase the penalty?+
Paying reduces interest. The late-filing penalty is about the return being late while tax was unpaid at the deadline. Filing is what stops the monthly count. Paying is what stops the interest clock.
